Both parties agree to pay their own damn attorney’s fees and opt out of any applicable statute to the contrary.
Both parties do not agree to any form of pansy arbitration or mediation. It is trial or nothing.
The Service is controlled, operated and administered by the Company from our offices within the USA. If you access the Service from a location outside the USA, you have violated our site’s limitation to users based in the United States. We will not comply with any non-American law, ESPECIALLY the ridiculous, anti-Free Speech, Democracy hating GDPR.

When we request support from third-party businesses that partner with us to develop our site, they log into your site from time to time and can see your data. We are notoriously protective at that and have refused entry on many occasions. However, since inception, we have allowed BuddyBoss support and Elementor support to access our back-end server. We have also refused BuddyBoss support when they requested that we edit our firewall to allow the entire country of India access because their support team resides in India. (Currently, only two nations other than the US are able to access our site, Puerto Rico and the Philippines).
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Our first method of data protection is to limit the time we retain information other than basic user information and financial transactions related to a purchase. As indicated above, data necessary to build a plan for you deleted seconds after you submit it. When you submit data, the data is merged instantly into a word document and then emailed to you. The email is encrypted. We do not store the word document. There is an option to store a password-protected pdf version of your document on the site to make the sharing of your plan and legal documents convenient. If you choose this membership option, you must assent separately that you agree that this does not violate your privacy and that you did not provide any information which was subsequently merged into the document that is of such sensitivity that it would constitute a violation so great as to warrant a claim of breach of privacy. Further, by the separate agreement, you will be asked to agree that the information you provide is necessary for legal documents that are public record and, by definition, these documents are not private. Documents that are public will be listed clearly on the separate membership agreement.
Financial data is processed by Stripe. See above. Data used to create documents is not stored in the normal meaning of that word. However, in some cases, the data is sent via webhook via a third-party vendor. The third-party is Zapier. The vendor that solicits the data in a web-based form created by us is Cognito Forms.
In the event of a data breach, we will notify you if you were affected. It is up to you to contact your financial services institution so that they can issue a new credit card number just in case your credit card number was compromised. Again, Stripe stores that information and uses the security safeguards that your financial institution takes. However, federal law offers protection as well. There is a time limit to avail yourself of these protections. We do not provide information about those protections but leave it to you to understand that the fear-mongering about data security conveniently forgets to include the fact that the law requires them to reimburse you if they are notified in a timely manner.
If your other personal data was compromised, i.e., your name, email, and any profile into you included, e.g., your photo, we will notify you with the sense of panic and urgency that is appropriate.
What third parties we receive data from
As far as we know, we do not receive any data from a third party unless you ask us to do so. The legal requirement to disclose this relates to those websites, which are many, that pass on your private information via web beacons, pixels, and cookies. We don't like that. We won't do that.
However, if you would like us to review data about your form a third party, e.g., your CPAs most recent letter about tax deductions, we will ask you to agree that you provided this data rather than a scary third party working for the Evil Empire.

We are not regulated by an industry. We do not offer legal advice or services. However, we believe our privacy policy meets or exceeds the standards provided by the bar associations of the nation and those who endeavor to scare everyone about confidentiality.
